The Small Claims Track (SCT) hears the most straightforward intellectual property cases, where less than £10,000 is claimed. Its focus is on claims relating to copyright, unregistered designs, passing off and trademarks. The hearings in the small claims track are short and informal, the parties are frequently unrepresented, and the loser seldom must pay the winner’s costs. Since 2019, claims in the small claims track (SCT) of the Intellectual Property Enterprise Court (IPEC) can be issued and heard in the Business and Property Courts (B&PCs) in Birmingham, Bristol, Cardiff, Leeds, Liverpool, Manchester, and Newcastle, as well as in London.
Adam Turley heads up the Carlisle office of ACID Legal Affiliate McDaniels Law. He advises on all aspects of intellectual property law, whether contentious or non-contentious, with a particular focus on litigious matters. Adam enjoys getting to know a business, its commercial aims and how its intellectual property can be utilised to achieve those aims.
